A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, October 7, 2024, at 7:00 p.m. at the Victor Town Hall, 85 East Main Street, Victor, NY to consider the following applications.
VICTOR HEIGHTS, 115-117 Victor Heights Parkway, the applicant is proposing to re-subdivide an existing parcel containing two existing light industrial buildings. The new proposed lot line, which will subdivide the existing parcel into two lots, is proposed between the two buildings. This new lot line would make both buildings out of compliance with the side setback requirements of the Light Industrial District (30 feet). The property lies within the light industrial zoning district and is owned by Victor Heights Campus, LLC.
TAMBE ELECTRIC, 614 Fisher Run, seeking an area variance for the reduction of the rear set-back from 30’ to 24’ for the construction of a 2700 SF building addition. The proposed addition also appears to be within the 75’ requirement from the watercourse labeled “drainage ditch” on the submitted site plan. The watercourse is identified on the USGS (United States Geological Survey Map) as a watercourse having a year-round flow. The property lies within the light industrial zoning district and is owned by Michael Tambe.
KISTNER, 1268 Brace Road, seeking an area variance for the reduction of the parcel setback from 100’ to 75’ for the construction \ placement of a shed that stables laying ducks where § 211-19 A (4) R-1n Zoning District Regulations states setback of 100 feet also shall apply to the stabling of horses, ponies or other animals kept as pets for recreation, but the setback will not apply to the keeping of household pets such as dogs or cats. The property lies within the residential 2 zoning district and is owned by Todd Kistner.
PHOENIX MILLS, 100-410 Phoenix Mills Plaza, seeking for an Area Variance to allow a 12 foot by 20-foot pergola style accessory structure to be built forward of the front line of the primary building where §211-31 G. (2). States Accessory structures are not permitted to be forward of the front line of the primary building. The property lies within the Commercial/Light Industrial District and the Route 96/251 Overlay District and is owned by Hendler & Associates, LLC.
