LEGAL NOTICE
A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, September 15, 2025, at 7:00 p.m. at the Victor Town Hall, 85 East Main Street, Victor, NY to consider the following applications.
WILKINSON, 439 Fisher Road, the applicant is requesting an area variance to construct a fence forward of the frontline of the primary structure. where § 211-41 states fences over two feet high shall not be erected nearer to a road than the front line of the principal building. The parcel lies within the Residential 2 district and is owned by Marcus Wilkinson.
CHICK-FIL-A, 7979 Pittsford Victor Road, applicant is requesting multiple area variances. (1) Open Space: (Section 211-46A) With the Project, the Project Site will result in 34.3% open space. The required shall include 35% open space. A prior area variance was granted on September 17, 2007 to allow for 34.6% open space on the Project Site.(2) Retain wall Fence (Section 211-31 (G)(2)) A 4-foot-high fence above retaining wall forward the principle building where no accessory structures are allowed forward primary building.(3) Meal Delivery Canopy (Section 211-31 (G) (2)) Meal delivery canopy is proposed forward of the principle building line where no accessory structures are allowed forward primary building line. (4) Drive thru canopies Sprinkler waiver (Section 83-4 (F) (2) (a)) The proposed drive thru canopies do not include sprinkler systems.(5) Flagpole Lighting (Section 131-11 (K)(2)) Floodlight to illuminate flagpole where Flagpole light shall consist of narrow beam spotlights or lamps, not floodlights. (6) Signage: (a) Western Elevation (Section 165-5(B)(3) One sign proposed (53 SF) where no signs permitted because not connected to a parking area of public right of way. (b) Southern Elevation (Section 165-5(B)(3) Two (2) signs totaling 100.65 where no signs permitted because not connected to a parking area of public right of way. (c) Eastern Elevation (Section165-5(B)(3) One (1) sign proposed (35 SF) where no signs permitted because not connected to a parking area of public right of way.(7) Monument Signage. (a) Monument Sign (Section 165-5(B)(1)) Chick-fil-A monument sign (15.50 SF), which would be the third monument sign on the Project Site where Tenant monument sign not permitted, only one monument sign identifying the building is permitted. (b) Monument Sign (Section 165-5(B)(6)) Chick-fil-A monument sign located 35 feet from edge of Route 96 pavement where Monument sign only permitted more than 35 feet from edge of Route 96 pavement. The property lies within the Commercial Zoning District and is owned by Eastview Mall, LLC.
