Conservation Easements

Conservation easements are legal agreements that allow landowners or municipalities to protect their properties from development or other forms of use for a period, or in perpetuity. In essence, conservation easements are a way for landowners to voluntarily give up some of their rights to use their land in exchange for preserving its natural, scenic, or historic value. 

Some conservation easements allow landowners to maintain ownership and control over their land, while others are more restrictive. More restrictive easements prohibit any activity within the area of the easement and are intended to be “no touch” easements.

These easements are recorded on the property’s Deed and recorded with the Ontario County clerk. Easements survive a change in property ownership.
