LEGAL NOTICE

A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, April 6, 2026, at 7:00 p.m. at the Victor Town Hall, 85 East Main Street, Victor, NY to consider the following applications.

CAPITAL ONE CAFÉ, 100-1020 Eastview Mall Drive (7979 St Rt 96) Capital One Café is requesting multiple variances for an external building mounted sign at Eastview Mall. (1) The leased area is completely internal to the mall, with no exterior frontage or exterior entrance § 165-5 states each tenant of a building, or plaza with a separate entrance to a public right-of-way, or parking area shall be entitled to an individual sign. (2) The proposed sign measures approximately 80 square feet in sign area. Hypothetically, If the tenant were to have an exterior entrance and frontage on the exterior of the mall, the building width in this area is approximately 31 linear feet. This would limit the signs square footage to 31 square feet per §165-5B.(3). (3) The proposed sign contains more than two type-faced fonts which is prohibited by §165-4A.(4). The parcel lies within the district and is owned by Eastview Mall, LLC.
